'Not wearing helmet can't be held as contributory negligence'

The Madras high court ruled that in a road accident resulting in death from multiple injuries, lack of helmet cannot be seen as contributory negligence. An appeal by an insurance company against a compensation awarded to the family of a 21-year-old engineering student, who died in a motorcycle accident, was overturned. The court emphasized that head injury wasn't the only factor leading to death.
