Yesterday, a New York City grand jury indicted Daniel Penny, who had been charged with second-degree (reckless) manslaughter in the choke-hold death of Jordan Neely on a NYC subway on May 1.

Penny has claimed that he put Jordan in a restraining choke-hold position because Jordan had been making violent threats to the passengers on the subway car, and Penny was attempting to hold him for police.

Penny is white and Neely was black.
