ED's power to arrest is 'not untrammelled': Delhi high court
Thursday, 19 October 2023 The Delhi high court has ruled that the Enforcement Directorate (ED) does not have the power to arrest a person under Section 50 of the Prevention of Money Laundering Act (PMLA). The court stated that the power to arrest lies in Section 19 of the PMLA, but even that power is not unrestricted. The court emphasized that authorities must comply with certain requirements before arresting a person. The ruling came in response to a plea seeking the quashing of summons issued by the ED.

Ranchi: Former Jharkhand Chief Minister Hemant Soren was granted bail by the High Court in a land scam case, leading to his release from jail this morning. The court found that, prima facie, Soren is not guilty and is unlikely to commit another offense while on bail. His counsel, Arunabh Chowdhury, confirmed the bail was granted on a bond of ₹50,000 and two sureties of the same amount each. Soren, leader of the Jharkhand Mukti Morcha, was arrested by the Enforcement Directorate on January 31 on money laundering charges related to the acquisition of 8.86 acres of land in Ranchi. The court's decision followed earlier setbacks for Soren, including bail denials by both the Ranchi special court and the High Court, and the Supreme Court's refusal of interim bail.
