Proposed H-1B rule: Helping international students navigate cap-gap

IndiaTimes Saturday, 21 October 2023
Proposed H-1B modernization rules could benefit international students on F-1 visas looking to switch to H-1B work visas. The rules would extend the cap-gap period, allowing students to continue working while waiting for their H-1B application to be processed. The proposed rules also provide a longer cap-gap protection period, extending from September 30 to April 1 of the following year. This would avoid a lapse in immigration status and ensure work continuity for students. The proposal is still undergoing the federal review process and may take months to finalize.
