SC: Babus must pay for loss to exchequer due to illegal acts
Wednesday, 6 December 2023
The Supreme Court has ruled that officers who make illegal decisions and those who benefit from them must reimburse the government. In a case where an officer was granted a higher pay scale unlawfully for 24 years, the court ordered the recovery of the excess amount paid. The court found that the officer received preferential treatment through the manipulation of rules and directed that the officer and the officials involved in the decision-making process be held equally responsible for reimbursing the government. The officer's colleagues, who were denied the same benefit, also approached the court.
