Police nor criminal court can seize passport, says Karnataka HC
Saturday, 16 December 2023 The High Court of Karnataka reiterated that neither the police nor the criminal court can seize or impound a passport under Sections 102 or 104 of the Criminal Procedure Code. The court quashed the order of the Debt Recovery Tribunal-1, Bengaluru, which impounded the passport of Mumbai businessman Nitin Shambhukumar Kasliwal. The court stated that the Tribunal, being a civil court, does not have the power to impound passports, as the Passport Act prevails over the powers of the civil or criminal court.
