Driver can escape harsher penalty by informing police

The driver of a vehicle that accidentally hits a person or another vehicle, causing death, but informs police or emergency helpline '108' of the accident soon after, whether from the site or elsewhere, will not be prosecuted under the more stringent provision of BNS that provides for up to 10 years' imprisonment and fine. As per Section 106 (2) of BNS, which is yet to come into force, "whoever causes death of any person by negligent driving of vehicle not amounting to culpable homicide, and escapes without reporting it to a police officer or a magistrate soon after the incident, shall be punished with imprisonment... which may extend to 10 years, and shall also be liable to fine".
