The Court refused to interfere, stating that the PIL is not maintainable as several civil suits on the same issues are already pending. The High Court had dismissed the PIL claiming that the mosque was built on forcibly acquired land, which the petitioner argued was not a proper mosque. The Supreme Court clarified that its dismissal does not prevent parties from challenging the vires of any enactment.
