Right to reputation: Law panel bats for retaining criminal defamation as an offence

The Law Commission has recommended retaining criminal defamation as an offence under Indian law, emphasising the right to reputation derived from the Constitution. Speech should only be illegal in specific circumstances that cause substantial harm. The Bharatiya Nyaya Sanhita, 2023 includes community service as an additional penalty to protect victims and mitigate misuse.
