HC to examine governor power to junk MLC names sent by government
Monday, 12 February 2024 The Telangana HC said that it will look into whether a governor has the authority under Article 171 (5) of the Constitution to reject names given by the government. Senior counsel Avinash Desai stated that while governor is required under Article 171 (5) to approve the names of distinguished people given by the government, she has option to review validity of cabinet's decision.
K. T. Rama Rao (KTR), the Working President of Bharat Rashtra Samithi (BRS) and Sircilla MLA, was summoned by the Anti-Corruption Bureau (ACB) for questioning in connection with the Formula-E race case. However, his advocates were not permitted to accompany him, leading to his return from the ACB office. The investigation, which relates to allegations under the Prevention of Corruption Act, 1988, and the Indian Penal Code, has sparked a legal dispute. KTR has challenged the procedural issues of the FIR and petitioned the Telangana High Court, urging that the summons be deferred until the court’s verdict. Meanwhile, ACB is set to issue fresh notices for further questioning.
