Day 2 of ballot review in the 22nd Congressional District

Tuesday was day two of judicial review of challenged ballots in the 22nd Congressional District Race.

News channel 2's caitlin irla joins us live here in the studio to tell us what's left to do.

Good evening kristen.

The ballot-by-ballot review continued in court today... so far, the challenged ballots in oswego, herkimer, cortland, and madison counties have been finished.

Tioga county didn't have any challenged ballots... so that leaves chenango, broome, and oneida counties.

Watching from the oneida county courthouse, state surpeme court justice in oswego county, scott delconte, went through the ballots to try to determine what should and should not be counted.

Attorneys for both candidates provided legal reasoning for their objections.

The biggest challenge will likely be oneida county.

The board of elections won't finish canvassing their ballots until sometime next week.

However, they did provide an update in court.

The oneida county board of elections has counted 90 votes as of yesterday as apart of their canvass... an attorney from the brindisi campaign says as of yesterday's count, the gap is between 3 to 5 votes... but did not specify who is in the lead.

In the district, there are more than two thousand challenged ballots.

About 17-hundred are from oneida county.

Justice delconte says he will reserve judgment on contested ballots until the conclusion of the hearings.

And it looks like 2021 will start without a representative in the 22nd congressional district seat... justice delconte says the review of challenged ballots will continue into january.
