24, the New York Supreme Court found that "being vaccinated does not prevent an individual from contracting or transmitting COVID-19.".

As a result, government employees who were fired for being unvaccinated must now be rehired and paid back wages.

In October of last year, David Chokshi, NYC health commissioner, issued an order forcing all city employees to get a COVID vaccine.

Mayor Eric Adams supplemented that demand with his own executive order that provided exemptions for a select few.

Porzio, who authored the opinion, found the city's reasoning to be hypocritical.

Fox News reports that in NYC alone, 1,400 workers were fired earlier this year for refusing the vaccine.

According to an NYC law department spokesman, “the city strongly disagrees with this ruling as the mandate is firmly grounded in law and is critical to New Yorkers’ public health.”
