The Supreme Court has stayed the conviction of Rahul Gandhi in a defamation case over his comment about the Modi surname. The court ruled that the trial judge must offer reasons for imposing maximum punishment for a non-cognizable offence. The Congress leader was sentenced to two years in jail by a Gujarat court over comments he made during a 2019 election rally. His conviction led to his disqualification as an MP under the Representation of People Act. The top court observed that Gandhi should have exercised caution in his speech but also questioned why no reason had been given by the trial court for the maximum sentence.
