The Bombay High Court held that a father should be capable of providing care and protection to a child regardless of their gender. The court directed the mother to hand over physical custody of their US citizen minor to the father for her repatriation to America. The court emphasized that it is the child's basic human right to have the care and protection of both parents. The mother's refusal to return to the US was deemed unjustified, and the court ordered her to hand over the child to the father within 15 days.
