Madhya Pradesh HC: Special Marriage Act won't legalise a union prohibited under personal law

Madhya Pradesh HC has ruled that marriage between a Muslim man and a Hindu woman is an "irregular (Fasid)" marriage according to Muslim personal law and it remains so even if the marriage is performed under Special Marriage Act. "Marriage under Special Marriage Act would not legalise the marriage, which is otherwise prohibited under Muslim personal law," stated Justice G S Ahluwalia.
